This Consent Policy (hereinafter — the «Policy») establishes the key rule for using the catalog Undress and connected third-party AI services: mandatory prior informed consent of depicted persons. The Policy is binding on all Users.
1. Main rule
You have the right to use AI services to process a photograph only when all of the following conditions are met simultaneously:
- you are 18 years of age or older;
- all depicted persons are 18 years of age or older;
- you have obtained the informed and conscious consent of each depicted person;
- you hold the rights to the original image;
- you do not intend to use the result for bullying, blackmail, defamation, or commercial exploitation without consent.
2. What is «informed consent»
Informed consent is a voluntary, conscious, and specific permission from the depicted person to process their photograph using AI services and to create derivative (including synthetic) images. For consent to be considered informed, the depicted person must understand:
- that the photograph will be processed by a neural network to generate a conditional «undressing»;
- that the result is a synthetic (fake) image;
- how and where the result will be used (personally, published, transmitted to third parties);
- that consent can be withdrawn at any time with a demand to delete the result;
- the possible legal and reputational consequences.
Consent must be obtained before uploading the photograph to the service. Silence, absence of objections, or a long-standing relationship do not constitute consent.
3. Legal grounds
Using images of people without consent violates:
- applicable criminal law on violation of privacy (e.g. Art. 137 of the Criminal Code of the Russian Federation — punishment up to imprisonment);
- applicable law on violation of correspondence, telephone conversations, postal, telegraphic, or other communications secrecy;
- applicable law on defamation (when distributing synthetic images discrediting honor);
- applicable civil law on the protection of a citizen's image;
- GDPR (EU) and national data protection laws (a photograph may be recognized as biometric personal data);
- for use regarding minors — applicable criminal law on child sexual abuse material and related offences.
Depending on the circumstances, the offender may be subject to civil, administrative, and criminal liability.
4. How to obtain consent
Consent may be obtained in any form that allows it to be proven (written, electronic, messenger). Recommended checklist:
- ✅ Clearly explain to the depicted person what will be done with their photograph (AI undressing, synthetic result);
- ✅ Specify the purposes and scope of use (personal / publication / transfer);
- ✅ Verify that the person is 18 years of age and legally capable;
- ✅ Obtain explicit consent in a form that can be saved (screenshot, correspondence, signature);
- ✅ Keep proof of consent in case of claims;
- ✅ Provide for the possibility of withdrawing consent and deleting the result.
5. Consequences of lack of consent
6. Reporting abuse
If your image has been processed without consent through a service listed in the catalog, you have the right to:
- contact law enforcement authorities (Ministry of Internal Affairs, Prosecutor's Office, Investigative Committee) with a statement on privacy violations;
- file a civil lawsuit for the protection of honor, dignity, and image;
- send a link removal request to the Site — via bot (see the DMCA procedure).
- contact the data protection authority on personal data matters.
The Site Administration undertakes to review such appeals on a priority basis and, if necessary, remove the link to the offending service from the catalog.
7. Special categories
- Minors (under 18): processing is prohibited in any case. Consent of parents or guardians does not make processing permissible;
- Former partners: the status of the relationship does not cancel the requirement for consent. Revenge porn is unacceptable;
- Public figures: being public does not mean consent to synthetic sexual content;
- Group photos: the consent of each depicted adult person is required.
